Terms and Conditions of Sale

1. Introduction

These Terms and Conditions govern the sale of goods by MAK Consulting p.h.u. Michał Nowak, trading as Import From Poland, to customers. By placing an order with us, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these Terms, please do not proceed with your order.

2. Definitions

  • "Company", "We", "Us": Refers to MAK Consulting p.h.u. Michał Nowak.
  • "Client", "You": Refers to the buyer, whether an individual, company, or legal entity.
  • "Goods": Refers to all building materials and other products offered for sale by the Company.
  • "Custom Order": Refers to goods that are sourced, made, or tailored specifically to the client's requirements.

3. Placing Orders

3.1. All orders must be submitted via our official communication channels, including our website, email or Whatsapp. Once an order is placed, you will receive an acknowledgment of receipt. This does not constitute acceptance of your order.

3.2. A contract between us is formed only once we confirm the availability of the goods and issue a formal order confirmation.

3.3. Custom orders will require full details from the client regarding specifications before the order is processed. The delivery schedule for custom orders will be provided on a case-by-case basis.

4. Price and Payment

4.1. Prices for goods will be as provided in a written quote. Prices are exclusive of VAT unless otherwise stated.

4.2. Payments must be made in accordance with the payment terms outlined in the order confirmation. We accept bank transfers and other payment methods specified on our website.

4.3. All fees related to shipping, handling, and import duties (if applicable) are the seller's responsibility unless explicitly stated otherwise.

5. Delivery

5.1. Delivery dates are estimates and may be subject to change due to factors beyond our control. We will inform you of any changes as soon as possible.

5.2. Delivery will be made to the address specified in the order confirmation. The client is responsible for ensuring that the delivery address is accurate and accessible.

5.3. It's client's responsibility to designate suitable unloading area and arrangements, including a forklift where necessary

5.4. Unless explicitly stated or arranged otherwise the deliveries over 500kg weight will come on articulated lorry. It's client's responsibility to ensure suitable access or discuss alternative delivery methods with us prior to placing an order

5.5. Risk of loss or damage to goods passes to the client upon delivery.

6. Custom Orders and Non-Refundable Goods

6.1. Custom orders, or those placed to specific client requirements (including items specially ordered, customized, or procured specifically for the client), are considered non-returnable and non-refundable. This applies to all goods that have been tailored to client specifications and sourced specifically on request.

6.2. By placing a custom order, the client acknowledges and agrees that these goods cannot be returned for a refund unless they are defective or not as specified in the order confirmation.

6.3. Any changes or cancellations of custom orders must be requested within 24 hours of placing the order. After this period, custom orders cannot be modified or cancelled.

7. Returns and Refunds for Standard Goods

7.1. We comply with the EU Consumer Rights Directive for distance selling, which grants consumers the right to return non-custom goods within 14 days of receipt.

7.2. Standard (non-custom) goods can be returned within 14 days of receipt, provided they are in unused and resellable condition. The client must bear the cost of return shipping unless the goods are defective.

7.3. To initiate a return, contact us within the 14-day period, and we will provide return instructions. Returned goods must be sent to our warehouse at:

7.4. Condition of Goods: Returned goods must be in unused, undamaged, and resellable condition. We reserve the right to refuse refunds for goods that do not meet these criteria.

7.5. Refunds will be issued within 14 days of receiving the returned goods, provided they are in acceptable condition as per the above criteria.

7.6. Exclusions from Returns:

  • Goods that are made to the customer’s specifications or clearly personalized.
  • Goods that are not suitable for return due to health protection or hygiene reasons (e.g., materials that have been unpackaged).

7.7. If goods are found to be defective or damaged upon receipt, we will either repair, replace, or refund the defective items at no additional cost.

8. Warranties and Liability

8.1. We warrant that the goods sold will meet the agreed specifications and be free from material defects for the applicable warranty period. However, minor variations in materials or appearance due to the nature of the building materials may occur and do not constitute grounds for returns.

8.2. Our liability for any claim, whether in contract, tort, or otherwise, arising out of or related to the sale of goods is limited to the purchase price of the goods supplied. Under no circumstances will we be liable for indirect, special, or consequential damages.

9. Cancellations

9.1. Orders for standard goods may be cancelled prior to shipment. If the order has already been shipped, the client may return the goods in accordance with our return policy.

9.2. Custom orders cannot be cancelled once production has commenced or materials have been procured. By placing a custom order, the client agrees to this condition.

10. Jurisdiction and Governing Law

10.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of Poland, and any disputes shall be subject to the exclusive jurisdiction of the courts of Poland.

10.2. If any provision of these Terms and Conditions is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

11. Force Majeure

We shall not be liable for any delay or failure to perform our obligations where such delay or failure results from circumstances beyond our reasonable control, including but not limited to acts of God, war, strikes, or supply chain disruptions.

12. Amendments

We reserve the right to amend these Terms and Conditions from time to time. Any changes will be posted on our website, and it is the client’s responsibility to review them before placing an order.
